Declaration–Registration Act, 1908–Sec. 47–Transfer of Property Act, 1882–Sec. 54–Suit for declaration on the ground of execution of sale deed in favour of the plaintiff–Decreed by the Trial Court–First Appellate Court set aside the judgment and held that the correction made in the sale deed was bonafide and was not fraudulently made–Justification–The corrections unilaterally made by the first defendant after the execution of sale deed without the knowledge and consent of the purchaser will have to be ignored–Only if such changes would have been made with the consent of the original plaintiff, the same could relate back to the date of the execution–Sale deed would be operated from the date when it was executed–High Court rightly restored the judgment of Trial Court.
