Rajasthan Stamp Act, 1998–Secs. 35 & 39–Application upto effect that the agreement in question is not properly stamped and, therefore, it cannot be allowed to be exhibited–Dismissal–Suit for specific performance of agreement of sale–Condition no. 2 of agreement itself revealing that the possession of land was transferred–Document will fall in ambit of conveyance as defined u/s.2 (xi) of Rajasthan Stamp Act–Impugned order of trial Court quashed and set aside and trial Court is directed to send the document for payment of necessary stamp duty.
