Penal Code, 1860–Secs. 307, 307/34 & 323/34–Conviction–Sustainability –Accused-appellants were attacked in their house by complainant-party–Dispute in regard to agricultural land–Previous enmity–No explanation in regard to the injuries sustained by accused-party–Injury sustained by accused H was grievous in nature–Appellants were having the right of private defence–Further, prosecution failed to show the overt act of accused T & H–Held, conviction cannot be sustained.
