Employee’s Compensation Act, 1923–Sec. 4 (l-B) (As amended w.e.f. 18-01-2010, Amendment Act No. 45 of 2009)–Whether the benefit of amended provision, deleting the deeming provision in Explanation II which capped the monthly wages of an employee at Rs. 4,000/- would apply to accident which took place prior to coming into force of it’s provisions I.e. 18-01-2010 and where final adjudication is pending ?–Held, no–Relevant date for determination of compensation payable is the date of accident and the benefit of amended provision does not apply to accident that took place prior to it’s coming into force.
