Indian Succession Act, 1923–Sec. 63–Will excludng one out of nine children who married out of the community–Concurrent findings disbelieving the Will–Sustainability–DW 2 spoke of the presence of the testator alongwith himself and the other attesting witnesses as also affirmed the signatures of testator and of both attesting witnesses in the document–He was in close association with the testator–His presence on the date of execution of the Will and registration is established–He stated the sound and disposing state of mind of the testator–Reason for exclusion of plaintiff is also stated–There can be no interference to the Will which stands proved unequivocally–Judgment and decree of High Court and Trial Court are liable to be set aside.
