Protection of Children from Sexual Offences Act, 2012–Sec. 6–After the conviction, appellant and victim of crime solemnized marriage and wife has blessed with a male child–She filed the affidavit before this Court that she is dependent on the appellant and wishes to lead a happy, normal and peaceful life with him–A balanced approach combining practicality and empathy is necessary–Crime was not a result of lust but of love–Continuation of the criminal proceedings and the appellant’s incarceration would only discrept the familial unit and cause irreparable harm to victim–Criminal proceedings including the conviction and sentence quashed with the specific direction to not deserting the wife and child.
