Penal Code, 1860–Secs. 366, 342 & 506–Conviction–Sustainability–It is doubtful that the victim was kidnapped while going to Nursing Home–She herself may have managed to elope with the appellant–Appellant never misbehaved with her or took advantage of her company–FIR was lodged after she informed about the incident to her uncle on the telephone–She frequently moved with appellant from one station to other station and never tried to escape or go back home–Marriage proposal of the appellant with her was dropped because the appellant was not having a govt. job–Now, both are married elsewhere and living happily–Appellant has suffered the ordeal of pendency of criminal prosecution–He is acquitted from the charge.
