Evidence Act, 1872–Sec. 65–Code of Civil Procedure, 1908–Order 7, Rule 14–While dealing with the application u/s. 65, trial Court observed that until and unless the documents are first taken on record, application u/s. 65 cannot be allowed and it proceeded to treat the application under Order 7, Rule 14–Held, Court below has done the substantial justice and took the documents on record–Evidence of plaintiff has just begun to start–Trial Court rightly exercised the discretion vested in it.
