Penal Code, 1860–Secs. 304–Applicability–Cause of death was haemorrhage due to an incised wound on the apex of the heart–The apex of the heart is the lowest tip of the heart located on the lower left side of the chest–Medical opinion that such an injury can cause death within five minutes of infliction–Appellant caused such bodily injury which in the ordinary course of nature was sufficient to cause death–Appellant participated in a premeditated attack on victim armed with a deadly weapon–His conduct is covered by both Clauses (1) & (3) of Sec. 300–No case is made out for altering the conviction.
