Contract Act, 1872–Sec. 16–Code of Civil Procedure, 1908–Order 6, Rules 1 & 2–Lack of allegation of undue influence–If there are facts on record to justify the interference of undue influence, such omission is not fatal to the plaintiff being entitled to relief on that ground–Court is to see that there is no surprise to defendant.
