Penal Code, 1830–Sec. 420–Code of Criminal Procedure, 1973–Sec. 482–Scope for quashing the criminal proceedings on the basis of having the civil nature–Complaint cannot be quashed only on the ground that the allegations made therein appear to be of civil nature–If the ingredients of offence alleged against the petitioner-accused prima facie make out in complaint/FIR then the criminal proceedings shall not be interdicted–In the civil suit, it will be decided whether petitioners are entitled to receive the suit property or not on the basis of document in question whereas the document is fabricated or not, cannot be decided in the civil suit.
