Penal Code, 1860–Sec. 376–FIR for the offence–Scope for lodging–There is a distinction between a false promise of marriage and a breach of promise which is made in good faith but subsequently not fulfilled–Allegations that the sexual exploitation was done from 2005-06 to 2017 on the pretext of promise of marriage–Nothing on record to show any kind of brutality or any kind of mal-intention on part of petitioner–Multiple pregnancies and multiple abortions without any protest indicate a domestic relationship akin to matrimony deviating after 12 years–FIR is liable to be quashed.
