Code of Civil Procedure, 1908–Sec. 11–suits wherein the common issues have been framed and common trial has been conducted, the losing party must file appeal in respect of all adverse decrees founded even on partially adverse or contrary speaking judgments–Decree not assailed thereupon metamorphoses into the character of a former suit and consequently operates as res-judicata.
