Recovery was made from the dhaba and the appellant himself claimed to be the owner of dhaba–All the independent witnesses present on spot were his servants and it cannot be expected that they would be the witnesses against their master–No chance of tampering with the seals of samples–Held, High Court was justified in reversing the findings of trial Court.
