Code of Criminal Procedure, 1973–Secs. 439 & 482–In FIR No. 501/2019, the petitioner, victim of the case has been arrested by the police–In exceptional cases, when the allegations of FIR are found false, the police may submit a complaint u/s. 182 Cr.P.C.–In the FIR No. 826/2021, neither the land got transferred nor the sale deed was executed–Complainant had no locus to lodge the FIR as he did not incur any loss–Case does not come within the definition given in Section 463 & 464–Further, there was no justification in arresting the petitioner while leaving the vendors free–Petitioner’s regular bail application is pending before the Co-ordinate Bench of this Court–It would be appropriate to pass the order of interim release of petitioner till the bail application is heard.
