Code of Criminal Procedure, 1973–Sec. 439–Narcotic Drugs & Psychotropic Substances Act, 1985–Secs. 8, 21, 29 & 30–Penal Code, 1860–Secs. 188, 201 & 109, 120-B–Traces of contraband substances were found from the kui (toilet)–It is an open pit of toilet which is used by the villagers of area and the same contains defecated waste–If there had been malafide intention of using or dealing in the contraband substance, the same could have been concealed by the appellants at any other place than kui–Embargo of Sec. 37 is not applicable in this case–Bail granted subject to certain conditions.
