Explosive Substances Act, 1908–Secs. 4 & 2(a)–Code of Criminal Procedure, 1973–Sec. 439–An explosive including Ammonium Nitrate as defined under Clause (d) of Sec. 4, is to be treated as arm explosive substance as defined under Clause (a) of Sec. 2, if the same is dealt with by a person in a manner and circumstances as mentioned in the provisions of Act–Offence would be non-bailable and he would not be entitled to bail as a matter of right.
