Code of Civil Procedure, 1908–Order 7, Rule 11–Rajasthan Tenancy Act, 1955–Sec. 207–Jurisdiction to try the case–Determinative aspect–It is not the nature of actual use of the subject land which is the real test to assess the jurisdiction of the Court but the nature of subject land–Irrespective of the actual use of land, if the nature of subject land is agricultural and the suit falls under Schedule III, the Revenue Court only shall have the jurisdiction to try it–Trial Court erred in dismissing the application.
