Penal Code, 1860–Secs. 498-A & 323–Code of Criminal Procedure, 1973 –Sec. 482–While dealing with the petition for quashment of proceedings, High Court did not refer the facts of case to appreciate the controvercy of the case–It was required to first set out the brief facts of the case with a view of understood the factual matrix and then examine the challenge made to the proceedings in light of principles laid down by this Court–Impugned order set aside and matter remanded back for deciding afresh.
