Narcotic Drugs & Psychotropic Substances Act, 1985–Sec. 52A–Petitioner sought the direction for taking the sample from the original article lying in malkhana for forensic examination to bring the true facts on record–Dismissal of application–Justification–Ground of petitioner that the sample sent for forensic examination does not represent the alleged contraband recovered from him–The process of sending the sample for FSL examination would serve the duel purpose of upholding the integrity of the prosecution case while simultaneously safeguarding an innocent person from an unwarranted conviction–Allowing of petitioner’s request does not in any manner confer undue primacy upon the defence over the case of prosecution–Present case does not fall within the purview of a defence exercise, rather it would ensure the sanctity and credibility of the prosecution case–Directed accordingly.
