Code of Criminal Procedure, 1973–Sec. 235(2)–Order of conviction and death sentence was passed commonly on the same day–Infraction of provisions of Sec. 235(2)–It would be open to the higher Court to remedy the breach by giving a hearing to the accused on the question of the sentence–Sentence cannot be commuted to life imprisonment on this ground.
