Negotiable Instruments Act, 1881–Sec. 143, Second Proviso–Conversion of complaints from summary trial to summons trial–Section mandates that the Magistrate has to record an order spelling out the reasons for such conversion–The discretion has to be exercised with due care and caution–High Courts are requested to issue practice directions to the Magistrates to record reasons before converting trial of complaints u/s. 138 of the Act from summary trial to summon trial.
