Motor Vehicles Act, 1988–Sec. 164–Limitation for filing the claim petition–In the absence of any statutory limitation prescribed by Parliament for the claim u/s. 164, this Court cannot legislate or read into the statute what it does not contain–The six-month limitation in Sec. 166(3) expressly governs the applications filed u/s. 166 only and this provision cannot be extended to a distinct self-contained and special provision like Sec. 164, which begins with an obstante clause–Tribunal rightly held that the claim petition filed u/s. 164 is not governed by the limitation u/s. 166(3).
