Code of Civil Procedure, 1908–Order 23–Withdrawal of appeal/petition–Continuity of interim relief–Scope of–If a petition is not maintainable and is ultimately withdrawn, the Court should not continue the interim relief for a period beyond the withdrawal of same–However, if the matter is heard on merits and after considering the facts of the case, Court permits the withdrawal of the case, the aforesaid condition would not be applied.
