Prevention of Food Adulteration Act, 1954–Sec. 13(2) Many accused’s in the present case–One of them exercised the right u/s. 13(2)–Sample was found deteriorated and it was not in a condition for analysis–It would be a sheer waste of time and an empty formality to get the third sample also declared as deteriorated–All the accused are entitled to getting the benefit–Proceedings against them deserve to be quashed.
