Code of Criminal Procedure, 1973–Sec. 167(2)–Narcotic Drugs & Psychotropic Substances Act, 1985–Sec. 18(c)–Denial from granting the default bail–Allegation that the petitioner was found cultivating poppy straw within the compound of his house and 7 kg. 100 gms. poppy straw was recovered from his possession–As per Notification, in respect of cultivation of poppy, irrespective of small quantity, more then small quantity or commercial quantity, the case would be governed u/s. 18(c) of the Act and maximum punishment provided is ten years–Investigation should have been completed within 60 days, which was not done even on the date of exercise of right of default bail–Impugned order is liable to be set aside–Petitioner is granted the bail subject to certain conditions.
