Penal Code, 1860–Secs. 302/34–Conviction–Sustainability–Case of circumstantial evidence–Motive of illicit relations of deceased with the sister of appellant was alleged but the lady allegedly having illicit relations was not identified by the Investigation Officer–No positive evidence on this point–Deceased was aged of 60 years whereas she was much younger–Exercise of dog tracking was conducted after 14 days–Further, the procedure of dog traking is not admissible in evidence–Conviction cannot be sustained on the mere ground of recoveries of blood stained clothes and weapons–Appellants are entitled to get the benefit of doubt.
