Opium Act, 1878–Sec. 4/9–Conviction–Justification–Recovery of 2.5 kgs opium–Malkhana incharge and makhana register was not produced before the trial Court to establish the fact that the samples were deposited in makhana–Prosecution failed to prove the fact that the samples were remained intact till reaching FSL–Held, petitioner is entitled to be acquitted.
