Evidence Act, 1872–Sec. 45–Penal Code, 1860–Secs. 498A & 304-B–Prayer with seeking the comparsion of handwritting of the suicide note allegedly left behind by the deceased–Rejection of–Justification–Suicide note would provide a very important piece of evidence for just decision of case–
Observation of trial Court that the father of deceased is an illiterate man and thus, he could not have identified the handwritting of his daughter, is per se perverse and contrary to record–Defence cannot be deprived of the opportunity of having the document examined through a govt. hand writting expert–Application deserves to be allowed.
