Rajasthan Minor Minerals Concession Rules, 1986–Rule 17(2)–Cancellation of mining lease–Four months delayed renewal application along with the application for condonation of delay–Rule 17(2) prescribes that if such application is received after the period prescribed under Rule 8(2), same can be entertained on payment of penalties and the delay of six months is condonable–No reason was assigned for refusing the renewal–Petitioner was not called to deposit the amount of penalty–Further, no action was taken in regard to allotment of lease to any other person–Mining area remained undeveloped due to inaction of respondents–Held, impugned order quashed and respondents are directed to pass appropriate order.
