Hindu Succession Act, 1956–Sec. 8–Rajasthan Tenancy Act, 1955–Suit for declaration and permanent injunction–Decreed–Disputed land belonged to R–N & K were his legal heirs–Plaintiff proved through the documentary evidence that the death of R occurred after coming into force the Hindu Succession Act and Rajasthan Tenancy Act–K and N were having equal share in the land–K had no power to execute the Will of entire land except his share–Findings given in the previous suit were not binding on the plaintiff because plaintiff was not a party in that suit–Therefore, the question of limitation would also not arise–Held, suit was rightly decreed.
