Code of Criminal Procedure, 1973–Secs. 311 & 309–Protection of Children from Sexual Offences Act, 2012–Sec. 33–Application for recalling certain witnesses–Dismissal of–Though the conduct of counsel of defence cannot be appreciated as the due opportunity was given but due to obnoxious behaviour of the party or counsel, one cannot be deprived from getting the justice–If on the basis of uncontroverted and unrebutted prosecution evidence the accused is convicted, then he shall be punished for a sentence of ten years or more–Opportunity is granted subject to the cost.
