Code of Civil Procedure, 1908–Order 22, Rule 10 & Sec. 146–Scope –While deciding an application u/s. 146 and Order 22, Rule 10, the Court is not required to go into the controversy as to whether the person sought to be impleaded as party in the suit is either necessary or proper party–If the person sought to be impleaded as the party is the legal representative of a party to the suit, it is sufficient for the Court to order impleadment/substitution of such person.
