Rajasthan Tenancy Act, 1955–Secs. 88,188 & 239–Indian Succession Act, 1925–Sec. 63–Evidence Act, 1872–Sec. 68–Whether the Revenue Courts can proceed to decide the title on the basis of Will which is registered?–Held, no–Same can be decided only by the competent Civil Court–Question of the title does not come under the purview of the Revenue Courts, where the title itself is in dispute–Document of Will was taken into consideration by all the three Courts but same lacks the provisions of Sec. 68 of Indian Evidence Act–Execution of same was required to be proved–Impugned judgments quashed and set aside and SDO is directed to refer the matter for decision of issue no. 3 by the competent Civil Court.
