Rajasthan Public Trust Act, 1959–Sec. 18–Rajasthan Public Trust Rules,1962–Rules 20, 21 & 23–Registration of trust–Order set aside by Appellate Authority and matter was remanded back–Appreciaton of–Appellate Authority concluded that the notices were not properly served on the parties concerned and an incorrect report was done–Further, there was non-compliance of provisions of Rules 20, 21 & 23 of Rules of 1962–Held, the order passed by Asstt.Commissioner was illegal and was rightly set aside by appellate authority–Further held, the appellate Authority remanded the matter back for holding
the proper inquiry after adequate opportunity to concerned persons, therefore,it was a just and proper order.
