Penal Code, 1860–Secs. 406, 419, 468, 471, 420, 448 & 427 r/w. 34–FIR for the offence–Sustainability–When one civil litigation had attained finality with no relief granted to the relatives of complainant and no interim relief was granted in another civil case, complainant filed this FIR with malafides–Delay of 60 years in initiating the dispute with regard to ownership of land–Resort of criminal proceedings was taken with an ulterior motive for oblique reasons–Even if the allegations are taken to be true on their face value, no offence can be said to be made out–FIR is liable to be quashed.
