Code of Civil Procedure, 1908–Order 41, Rule 5–First Appellate Court stayed the operation and execution of the judgment of Trial Court–However, the order is not reasoned on the point of payment of mesne profit –Held, it shall be open for the plaintiff to move a fresh applicaton praying the mesne profit also as for enhancement in mesne profit during the course of appeal.
