Rajasthan Land Revenue Act, 1956–Sec. 91–Rajasthan Tenancy Act, 1955–Chapter III-B–Land in question was transferred in favour of writ petitioners by virtue of decree passed by Revenue Court–Same was not recognized by the authorised officer while determining the excess land in hands of assessee–However, for this reason, it cannot be deemed that the decree passed by revenue Court was not binding over the both parties–Land was mutated in favour of respondent nos. 7 to 10 and they became khatedar–It was not open for the assessee to surrender the same land towards the acquisition–Single Judge rightly quashed the notice u/s. 91.
