Rajasthan Tenancy Act, 1955–Secs. 175 & 214–Order of terminating the tenancy rights–Set aside by RAA–BOR reversed the order of RAA–Justification–Plea of petitioner that the application u/s. 175 was filed after the expiry of 30 years, actual possession of the land was never handed over to the purchasers and the Civil Court had passed the order declaring the sale deeds as void–BOR eluded the addressal and consideration of certain germane issues raised by the petitioner–No specific findings over the possession of disputed land–Further, BOR did not give any reason for non-filing of the appeal by the subsequent purchasers, who were allegedly deemed to be dispossessed–Matter deserves to be remanded back for fresh adjudication.
