Penal Code, 1860–Sec. 302–Conviction–Appreciation of–Conviction based on dying declaration–Deceased stated that appellant tied her hands and poured kerosene and set her on fire–Appellant used to drink liquor–He demanded Rs. 100/- –On refusal, he became angry and committed offense–No explanation by the appellant–Though the witness who took the deceased hospital turned hostile, the accused cannot be escaped because of clinching circumstances–Dying declaration was found reliable and supported by the endorsement of doctor–Held, the conviction was justified.
