Code of Civil Procedure, 1908–Sec. 80(2)–Suit was not maintainable against the State and it’s authorities without giving the notice u/s. 80 of C.P.C.–Nothing on record seeking the leave from the Court for dispensing with issuance of the notice as provided u/s. 80(2)–Impugned judgment deserves to be set aside.
