Rajasathan Tenancy Act, 1955–Sec. 251–Code of Civil Procedure, 1908–Sec. 100–Suit for permanent and mandatoy injunction–Decreed–Instant second appeal–Dispute relates to a way and it is an admitted position that the way is an agricultural land–As per Section 251 of R.T. Act, the revenue authorities have jurisdiction to try the suit–Impugned judgment and decree passed by Trial Court and Appellate Court are liable to be set aside.
