Rajasthan Court Fees & Suit Valuation Act, 1961–Secs. 41(d) & 29–Suit for permanent injunction and restraining from eviction–Tenant was evicted forcibly during the pendency of suit–Amendment in plaint–Allowed with giving the direction of paying Court Fees u/s. 29 of Act–Justification–Court fees was required to be furnished upon the rent of immovable property and not on the market value of it–Sec. 41 will be applicable–Order impugned set aside and directed to accept the Court fees in view of Sec. 41.
