Partition–Land in question was the ancestral land–As per mutation, it was not gifted by R in favour of defendant no. 1–Defendant no. 1 was the eldest son of P, and he was the karta of joint family–He represented the estate of M as karta–Stand of P that the property was gifted to him is without evidence–Impugned findings recorded by the High Court are not correct–Parties are entitled to get 1/10 share in the property.
