Code of Civil Procedure, 1908–Sec. 151 & Order 7, Rule 11–Application u/s. 151–Dismissed–In the application, the same facts were averred which had already been averred in the earlier application under Order 7, Rule 11–That application was dismissed back away in the year 2017 and the present application was preferred in the year 2019 at the stage of defendant’s evidence –Further, application for same relief by invoking the provisions of Sec. 151 could not have been entertained by the Court–Held, the application was rightly dismissed.
