Penal Code, 1860–Sec. 409–What is to be established by the prosecution ?–Held, the prosecution is not to prove that in what manner the property entrusted to the accused was misappropriated or converted or disposed of by him–Prosecution is obliged to prove that some property was entrusted to the accused and he misappropriated it.
