suit for specific performance of sale as regard to same premises–Suit for eviction has been adjudicated by both the Courts below and it is at the third stage of second appeal whereas suit for specific performance is pending at the stage of appellant-plaintiff’s evidence–Doctrine of res subjudice is insignificant and superfluous.
