Code of Civil Procedure, 1908–Sec. 10–Applicability of provision–The
fundamental test to attract Section is whether on final decision being reached in the previous suit, such decision would operate as res jusdicata in the subsequent suit–When both proceedings are entirely distinct, Sec. 10 would have no application.
