Rajasthan Rent Control Act, 2001–Sec. 9–Eviction on the ground of
personal and bonafide necessity, material alteration and change in use of premises–Findings reversed by appellate Tribunal–Justification–Another shop was let out in year 1999 whereas the eviction petition in this case was filed in year 2007–Findings in regard to personal & bonafide necessity were wrongly reversed–No evidence available on record to show that the shop was rented for running photo-studio–Land-lord failed to discharge his burden–However, eviction petition succeeds on the ground of personal and bonafide necessity.
