Rajasthan Panchayati Raj Election Rules, 1994–Rules 80, 17 & 35(2)–Rajasthan Panchayati Raj Act, 1994–Sec. 43–Election of petitioner was set aside on the ground that voters from the other parts were wrongly permitted to cast their votes in the petitioner’s ward–Voting in accordance with the electoral roll for a constituency cannot be held to be improper reception of the votes to furnish a ground of challenge the election process under the Rule 80 and validity of an electoral roll cannot be examined in the election petition–Tribunal exceeded its jurisdiction in passing the impugned order.
